Welcome to battlegrid.io ("the Game", "we", "us", or "our"). By accessing or using our game at battlegrid.io or battlegridio.onrender.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Game.

1. Acceptance of Terms

By entering a player name or accessing any part of battlegrid.io, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. battlegrid.io does not require user accounts to play; access is session-based.

2. Eligibility

You must be at least 13 years old to use battlegrid.io. If you are under 18, you represent that you have obtained parental or guardian consent to use the Game. By using the Game, you represent and warrant that you meet these eligibility requirements.

3. Game Access and Player Identity

3.1 Access

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use battlegrid.io for your personal, non-commercial entertainment purposes, subject to these Terms.

3.2 Player Names

When entering the Game, you may choose a display name. You agree that your chosen name will not:

• Be offensive, vulgar, or contain profanity
• Impersonate any person or entity
• Infringe on any trademark, copyright, or other proprietary rights
• Contain spam, advertising, or promotional content
• Be misleading or deceptive

We reserve the right to reject, change, or remove any player name that violates these Terms.

3.3 Session Responsibility

You are responsible for actions taken during your gameplay session. Do not share links, tools, or methods that grant others access to control your session. We are not liable for any loss or damage arising from misuse of your device or network.

4. User Conduct

You agree to use battlegrid.io in accordance with all applicable laws and regulations. You agree NOT to:

• Cheat or Exploit: Use hacks, bots, scripts, exploits, or any unauthorized third-party software that modifies or automates gameplay
• Harass Others: Engage in harassment, bullying, hate speech, or discriminatory behavior toward other players
• Disrupt Service: Attempt to disrupt, overburden, or disable the Game servers or infrastructure
• Reverse Engineer: Decompile, reverse engineer, or attempt to extract source code from the Game
• Distribute Malware: Upload, transmit, or distribute viruses, malware, or any harmful code
• Commercial Use: Use the Game for any commercial purpose without our express written permission
• Impersonate: Impersonate our staff, moderators, or other players
• Spam: Send unsolicited messages, advertisements, or spam through the Game
• Session Misuse: Attempt to share, sell, or transfer control of an active gameplay session to others
• Data Mining: Use automated systems to collect data from the Game without permission

5. Moderation and Enforcement

5.1 Violations

We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including but not limited to:

• Warning the offending player
• Temporarily kicking the player from the current session
• Permanently banning the player's IP address
• Taking legal action for serious violations

5.2 No Guarantee of Access

We do not guarantee uninterrupted or error-free access to battlegrid.io. We reserve the right to suspend, modify, or discontinue any aspect of the Game at any time without notice or liability.

5.3 Appeals

If you believe you have been wrongfully banned or moderated, you may contact us at team@battlegrid.io with details. We will review appeals on a case-by-case basis, but our moderation decisions are final.

6. Intellectual Property

6.1 Ownership

battlegrid.io, including all content, features, functionality, graphics, code, design, and compilation, is owned by us and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Limited License

These Terms grant you a limited license to access and use the Game. This license does not include any rights to:

• Reproduce, distribute, or create derivative works
• Use the Game for any commercial purpose
• Remove any copyright, trademark, or proprietary notices
• Transfer or sublicense your rights

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Game, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.

7. Virtual Items and Currency

Any virtual items, weapons, shields, or other in-game content have no real-world value and cannot be exchanged for real currency. We reserve the right to modify, remove, or discontinue any virtual items at any time.

8. Third-Party Services

battlegrid.io may integrate with third-party services (e.g., advertising networks like Google AdSense). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Basis

BATTLEGRID.IO IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY.

9.2 No Guarantees

We do not warrant that:

• The Game will meet your requirements or expectations
• Access will be uninterrupted, timely, secure, or error-free
• Results obtained from the Game will be accurate or reliable
• Defects or errors will be corrected

9.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF BATTLEGRID.IO, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.4 Maximum Liability

Our total liability for any claims arising from these Terms or your use of the Game shall not exceed $100 USD or the amount you have paid us (if any) in the twelve months preceding the claim, whichever is less.

10. Indemnification

You agree to indemnify, defend, and hold harmless battlegrid.io, its operators, developers, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Game
• Your violation of these Terms
• Your violation of any third-party rights
• Your conduct in the Game

11. Privacy and Data

Your use of battlegrid.io is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Game, you consent to our data practices as described in the Privacy Policy.

12. Changes to Terms

13. Termination

You may stop using battlegrid.io at any time by simply closing your browser or disconnecting from the Game.

13.2 By Us

We may terminate or suspend your access to the Game immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• At our sole discretion for any or no reason

13.3 Effect of Termination

Upon termination, your right to use the Game will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute with us, please contact us first at team@battlegrid.io so we can attempt to resolve it informally.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

14.3 Arbitration

Any dispute arising from these Terms or your use of the Game shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property disputes or violations of these Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and battlegrid.io regarding your use of the Game and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, or internet service provider failures.

BY USING BATTLEGRID.IO, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE GAME.
